Frequently Asked Questions

Common questions about family law matters.

Under the new no-fault divorce system, a divorce typically takes 6-8 months from application to final order, provided all paperwork is in order and there are no disputes.
While not legally required, having a solicitor ensures your rights are protected, paperwork is completed correctly, and financial or children arrangements are properly addressed. We offer fixed-fee divorce packages.
The court's paramount consideration is the child's welfare. Factors include the child's wishes (depending on age), physical/emotional needs, likely effect of change, any harm risk, and the parents' ability to meet the child's needs.
Mediation is a voluntary process to resolve disputes outside court. For most family matters (except domestic abuse cases), you must attend a Mediation Information & Assessment Meeting (MIAM) before applying to court.
Prenuptial agreements are not automatically binding but are increasingly influential if properly drafted, both parties had independent legal advice, full financial disclosure was made, and it was signed at least 28 days before the wedding.
